Can you use ChatGPT output commercially?
Yes, on any plan including the free one. OpenAI puts it in the terms:
- "As between you and OpenAI, and to the extent permitted by applicable law, you (a) retain your ownership rights in Input and (b) own the Output."
- OpenAI goes further and assigns you its own rights: "We hereby assign to you all our right, title, and interest, if any, in and to Output."
- Unlike ElevenLabs or Midjourney, there is no plan gate and no revenue threshold on commercial use.
- Two catches that are not about the license: output is not always unique, so another user can generate something close, and owning a file is not the same as copyright protecting it.
What this means for marketers
The license is the easy part here and OpenAI gives you everything it has. The risk sits elsewhere: whether the output is protectable at all, and whether anything confidential went into the prompt that produced it.
