ElevenLabs and AI content

The 2 questions marketers ask about ElevenLabs, each answered from ElevenLabs's own policy rather than someone's summary of it.

Can you clone a voice for a campaign?

Only with the rights to that voice, and the terms take something back:

  • ElevenLabs prohibits cloning a person’s voice without their consent or a legal right to it.
  • Its terms take a license to use your voice models to run and improve the service and to develop new products.
  • Voice cloning is also where US state likeness laws and the FCC’s robocall rules bite, so consent from the speaker is not the only permission you need.
  • Separately, the plan matters: free accounts are not licensed for commercial use at all.
What this means for marketers

Consent or rights to the voice are required, and likeness laws apply on top. Worth considering keeping written permission filed with the campaign, so the rights travel with the work instead of living in somebody’s inbox.

Can you use ElevenLabs audio commercially?

Only on a paid plan. The free tier is licensed for personal use and nothing else:

  • The terms are explicit: a Free User "may only use the Services for non-commercial purposes".
  • A Paid User "may use the Services for commercial purposes", so client work, ads, and monetized video all need a paid subscription.
  • There is a tell in the terms worth noticing: non-commercial use "must" be on a personal email address. A voice generated on a free account under a company domain is already outside the license.
  • Paid or not, the Prohibited Use Policy still applies, and so does consent for any real person’s voice.
What this means for marketers

A free-tier export in anything that makes money breaches the license, no matter who consented to the voice. Worth checking which plan the audio was actually generated on before it ships, because this is the kind of thing nobody asks about until a client’s legal team does.
